BooksForSchool.ca User Agreement and Guidelines (Updated August 1s 2005)

If we change this End User License Agreement, we will post the revised version of the agreement on our website, and that document will automatically replace the terms of this agreement. If you as a member continue to use our site after we post the revised agreement, you will be subject to the terms of the new agreement 5 days after that agreement is posted on our website. Failure to adhere to the terms of this license agreement voids your status as a member of this site, and we can terminate your membership at will. You must follow these guidelines to continue to use this site.

All information available through "BOOKS FOR SCHOOL" ("Information") is the property of BOOKS FOR SCHOOL or its information providers and is protected by copyright, intellectual property and personal property laws. All rights reserved.

You may not reproduce, retransmit, disseminate, sell, publish, broadcast, or circulate any Information without the express written consent of BOOKS FOR SCHOOL. You are entitled to use the Information for your private, non-commercial use only.

BOOKS FOR SCHOOL does not guarantee the accuracy, completeness, timeliness, or correct sequencing of any of the Information on the Site, including, but not limited to Information originated by BOOKS FOR SCHOOL, licensed by BOOKS FOR SCHOOL, or gathered by BOOKS FOR SCHOOL from publicly available sources.

BOOKS FOR SCHOOL MAKES NO REPRESENTATIONS OR WARRANTIES, WHETHER EXPRESS OR IMPLIED, ABOUT THE SUITABILITY OF THE INFORMATION, SOFTWARE, PRODUCTS, OR SERVICES CONTAINED IN "BOOKS FOR SCHOOL". ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.

BOOKS FOR SCHOOL, SHALL HAVE NO LIABILITY, CONTINGENT OR OTHERWISE, FOR THE ACCURACY, COMPLETENESS, TIMELINESS, OR CORRECT SEQUENCING OF THE INFORMATION OR FOR ANY DECISION MADE OR ACTION TAKEN BY YOU IN RELIANCE UPON THE INFORMATION ON "BOOKS FOR SCHOOL," OR FOR INTERRUPTION OF ANY DATA, INFORMATION, OR ANY OTHER ASPECT OF "BOOKS FOR SCHOOL".

Member Agreement:

To become a member of booksforschool.ca, you must be a Canadian citizen or permanent alien, 18 years of age or older (or have authority from a guardian 18 years or older). You must be able to legally enter into binding contracts such as the contract to sell a book after confirming your desire to sell. All registration information provided is required to be accurate in order for you to become a member of booksforschool.ca.

We are not responsible for the results of any transactions beyond the information traded. Our service is to connect people with information, and any actions of circumstances resulting from this trade of information is completely not our responsibility.

By completing the membership registration process, you expressly agree to be bound by the terms and conditions below and any other terms, conditions, notices and disclaimers displayed elsewhere through BOOKS FOR SCHOOL. If you object to these terms and conditions or any subsequent modifications to them, or become dissatisfied with your membership through BOOKS FOR SCHOOL in any way, your only remedy is to immediately:
a) discontinue your use of the BOOKS FOR SCHOOL web site; and
b) terminate your membership by notifying BOOKS FOR SCHOOL WEBMASTERS in writing

When registering as a member of the BOOKS FOR SCHOOL web site, you must provide BOOKS FOR SCHOOL with accurate, complete and up-to-date information as requested. It is your responsibility to inform BOOKS FOR SCHOOL of any changes to that information. You may do this at any time by clicking on the 'My Account' button within the BOOKS FOR SCHOOL site.

All personal information you provide BOOKS FOR SCHOOL as a member will be treated with accordance to the BOOKS FOR SCHOOL Privacy Policy.

Once you become a member of BOOKS FOR SCHOOL website, you will receive a username and a password. You must ensure that these remain confidential at all times since you are entirely responsible for all activities which occur under your username and password, including unauthorized activities. You must notify BOOKS FOR SCHOOL webmasters immediately if you become aware of any unauthorized use of your username and password.

Each username and password must be used by a single user and is not transferable.

BOOKS FOR SCHOOL may at its discretion terminate your membership of, or access to, the BOOKS FOR SCHOOL website at any time. If this happens we will not notify you.

In such event:

• you are no longer authorized to access the BOOKS FOR SCHOOL website;


• you will continue to be subject to and bound by all restrictions imposed on you by these terms & conditions;


• and all licenses granted by you and all disclaimers by BOOKS FOR SCHOOL and limitations of BOOKS FOR SCHOOL liability set out in these terms and conditions or elsewhere on the BOOKS FOR SCHOOL website will survive.

BOOKS FOR SCHOOL may change or discontinue any feature of the BOOKS FOR SCHOOL website including content, hours of availability and equipment required for access.

POLICY ON FALSE AND OFFENSIVE INFORMATION:

As a user of booksforschool.ca, you agree that all information provided about any listed materials is accurate to the best of your knowledge, and you will not attempt to defraud other users by posting inaccurate information. We reserve the right to terminate any user's account and delete all his or her listings without notice if they do not honor this user agreement in good faith. The decision as to whether or not this user agreement has been honored will be at the sole discretion of booksforschool.ca.

As a corollary, pleased be warned that it is the nature of user provided information, in the way of user posted class listings, book titles, authors, descriptions, and any other user posted information, to possibly be inaccurate, obscene, derogatory, or offensive. We will make our best attempt to filter out any of this type of offensive text and information, but we cannot do this immediately, and we may miss some offensive material, and thus booksforschool.ca cannot be and is not responsible for inaccurate, offensive, obscene, or derogatory, material on our site. If you run across material on our site that offends you, PLEASE send us an e-mail through the feedback link and we will attend to it promptly.

LIABILITY:

In no case shall booksforschool.ca or any users of our service be liable for any loss of money, GPA, or time as a result of use of this site or transactions with other users. Please use our service at your own risk.

Our rating system is in place in an attempt to determine a user's trustworthiness, especially in the case of sending books through the mail. If a transaction with a user does not go through, even after confirming intent to purchase by buyer, and intent to sell by the seller, you have the option of filing a report with booksforschool.ca either through e-mail or on the site.

Meeting with a buyer or seller can be RISKY. booksforschool.ca HIGHLY RECOMMENDS MEETING IN THE DAYTIME IN A MODERATE TO HEAVILY TRAFFICKED LOCATION. Please use common sense when meeting a buyer or seller. booksforschool.ca is in no way responsible for any unexpected outcome of a meeting between a buyer and a seller. After both parties have agreed to buying/selling a book, the matter is LEGALLY OUT OF OUR HANDS ENTIRELY.

BOOKS FOR SCHOOL may change and update these terms and conditions, the BOOKS FOR SCHOOL Conditions of Use or the BOOKS FOR SCHOOL Privacy Policy at any time. Updated versions of these documents will be posted on the BOOKS FOR SCHOOL website. You are responsible for ensuring that you regularly review these documents. Your continued use of the BOOKS FOR SCHOOL website after any such changes are made will be deemed to constitute your acceptance of those changes.
